These Terms of Service (“Terms”) govern your access to and use of the Streako mobile application, website, and related services (collectively, the “Service”).

The Service is operated by Andrew Johnson, the creator of Streako (“we,” “our,” “us”).

By creating an account, accessing the beta, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Streako (or the minimum age required where you live).

If you are under 18, you confirm that you have permission from a parent or legal guardian.

2. Beta Disclaimer

Streako is currently in beta, meaning the app is still under development.
By participating in this beta, you understand and agree that:

• Features may change, break, or be removed.
• The app may contain bugs, errors, or incomplete functionality.
• Data, streaks, logs, progress, and user content may be lost, reset, or deleted at any time.
• We do not guarantee storage or preservation of any data during beta testing.
• Access to the beta may be limited or revoked at any time.
• We may restrict the number of beta users or limit access to certain features at our discretion.

3. Your Account

• You must provide accurate and up-to-date information.
• You are responsible for keeping your password secure.
• You are responsible for any activity that occurs under your account.

4. Acceptable Use

You agree not to:

• Use the Service for unlawful, fraudulent, or harmful purposes.
• Harass, threaten, or abuse other users.
• Upload inappropriate, violent, or explicit content.
• Attempt to disrupt, hack, or exploit the Service.
• Use the app in a way that manipulates streaks, challenges, or leaderboards.

We may limit or remove access if these rules are violated.

5. Wellness & Safety Disclaimer

Streako is not a medical or health service.

The app provides wellness tracking, social accountability, and AI-generated guidance for informational purposes only.

You acknowledge that all fitness or wellness activities you participate in are at your own risk.

Always consult a licensed healthcare professional before changing your exercise, nutrition, or wellness routine.

We are not responsible for injuries, health issues, or results related to your use of the Service.

6. Payments & Subscriptions

If any paid features are enabled during beta testing:

• Payments are processed securely through the App Store or Google Play.
• Subscription terms and renewals are controlled by your app store settings.
• Purchases made during beta have no guarantee of future availability or pricing.

7. Virtual Items

Streako may include virtual items (AI coaches, badges, avatars, etc.). You understand that:

• These items have no real-world cash value.
• They cannot be transferred, traded, or resold outside the Service.
• Items may change or be removed during beta testing.

8. User Content

You may upload content such as workout logs, images, posts, or messages. You retain ownership of your content, but you grant us a worldwide, royalty-free license to use, display, and distribute it within the Service for the purpose of operating and improving the platform.

You are responsible for ensuring your content does not violate laws or infringe on others’ rights.

9. Data & Privacy

Your use of the Service is governed by the Streako Privacy Policy, which forms part of these Terms. The Privacy Policy explains how we collect, store, process, and use your information.

Because the Service is operated by an individual during beta, you acknowledge that:

Data may be stored or processed using third-party tools or service providers.

You should not upload sensitive personal information beyond what the app requests.

10. Termination

We may suspend or terminate access to the beta at any time for any reason, including violations of these Terms or technical issues.

You may delete your account at any time.

11. Disclaimers

The Service is provided on an “as is” and “as available” basis.
We make no warranties or guarantees regarding:

• reliability
• accuracy
• uptime
• fitness results
• availability of features

Your use of the Service is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages.
• We are not liable for any loss of data, loss of progress, loss of virtual items, loss of streaks, or loss of access to the Service.
• We are not liable for any injuries, health issues, or damages arising from your fitness activities or use of the Service.
• We disclaim all financial liability of any kind.
• Your sole and exclusive remedy for any dissatisfaction with the Service is to stop using the Service and delete your account.

You agree that you use the Service entirely at your own risk..

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. You agree that any disputes arising from these Terms or your use of the Service will be resolved exclusively in the state or federal courts located in California, unless otherwise required by applicable law.

14. Changes to These Terms

We may update these Terms from time to time. If changes are significant, we will notify beta users through the app or by email.

Continued use of the Service means you accept the updated Terms.
